This story headed AUSTRALIA v ELON MUSK first came to our attention at the end of last year.

Part 1 under this heading was posted on 20 December 2025.    It concerns a case of alleged defamation - by an invitee/interviewee on a Twitter X-Spaces audio discussion forum - of a religious organization and secret society that goes by the name Ordo Templi Orientis, or OTO for short. Members claim to have a religion they call Thelema.      

In that post made last year, we predicted that the plaintiff would win.     

It is common knowledge (from Wikipedia) that Ordo Templi Orientis is built on the occult, sexually-perverted and anti-Christian ideas arising from the life and mystical obsessions of the notorious bisexual Satanist Aleister Crowley (1875-1947).  

In Australia, OTO - this devil-worshiping sex cult - gained tax-exempt status on the back of the High Court of Australia's landmark ruling of Oct 27, 1983 legally recognizing Scientology as a religion. 

In overturning lower court decisions, the High Court established a new, broader legal definition of "religion" that moved away from strictly theistic or Christian-centric models.     

The court case

The 111-page final decision of the long-running case was published on 19 May 2026. 

It appears to have created an legal precedent, using defamation law, to essentially sabotage Elon Musk's aim of bringing free speech to critical thinkers & conspiracy theorists alike, in Twitter/X's new audio discussion forum feature called X-Spaces. 

Up to May 19, 2026 it was open slather on X-Spaces for Australian's engaged in "pub talk", be it for example focussed on 9/11, the COVID scam, the Jeffrey Epstein class, or whatever. 

If these ideas and conspiracy theories can be thrashed out by ordinary people in a free market place of ideas, like on a soap box Hyde Park,  then there is nothing to fear, the truth has a way of emerging over time. 

Notwithstanding, free public discussion of these sort of conspiracy theories can cause a problem for US-aligned governments, especially in relation to 9/11 conspiracy theories that tend to undermine the moral basis of US foreign policy to which Australia is tied through the ANZUS treaty.   

Thus the Australian Security Intelligence Organization (ASIO) has a duty to ensure that public opinion and radical ideas do not undermine Australia's social cohesion and hence national security.   

As a result of this May 19, 2026 legal precedent in the District Court of New South Wales, Australia, Twitter (X-Spaces) can no longer be considered a free-speech zone in the democratic market place of ideas. 

We at Fifth Estate Press are researching this precedent-setting case in the interest of citizen journalism and it's survival mechanism, that is, freedom of speech.

The witness statement made to the court.

With this in mind, we publish below the statement of the plaintiff's only witness, who has been stalking the X-Spaces invitee's seemingly homophobic internet crusade for a few years, according to all reports in the Twittersphere.   

This statement says that the plaintiff and this only witness are “friends", working together to stalk & target the invitee/interviewee who it appears is their public enemy number one.  

This statement came into our hands from sources that we are not at liberty to disclose.   We've provided a text summary of the document below, with appropriate redactions to protect the privacy of the witness. 

This will demonstrate the extroardinary amount of attention & care put into providing the court with evidence of publication.  

What is rather odd, is that the X-Spaces invitee/interviewee who was responsible for the actual alleged defamation, got off scott free!   

It was the host/interviewer who got sued, not for actual defamation, but for publication or dissemination of the invitee's opinions & beliefs about Ordo Templi Orientis. 

 In reality, more likely than not, it was innocent dissemination, however the lawyers representing the plaintiff made out arguments suggesting it was guilty dissemmination.         

It was only Mr David “Guru” Graham, the host/interviewer of the X-Spaces show, who was originally sued by the plaintiff.   

From media reports, this individual was a real fair-dinkum Aussie concreter from Wollongong, who lives in a boat owned by his wife.  So. . .  he's not really suitable as a target for a defamation case, the remedy for which is always the payment of monetary damages to the plaintiff.

Charging the co-host 

It seems that later, the co-host of the X-Spaces show was dragged by the experienced defamation legal team representing the plaintiff, into the into legal quagmire, as co-defendent. 

She is a mother from Tasmania who joined the subject X-Spaces discussion mainly due to the group's interest in the COVID conspiracy issue.   

She had minimimal involvement in the show.

It's assumed the plaintiff and his "friend" wished to recover their huge legal costs and believed she was a more suitable target for a damages award, because she appeared, from her internet website, to live in a expensive looking house. 

The 19 May 2026 decision ordered the defendent and co-defendent to jointly pay all the plaintiff's legal costs.  In addition they were ordered to pay him $235,000 in compensatory damages plus $80,000 in agravated damages for harm to his reputation - or what is left of it - after openly identifying as the public face of Ordo Templi Orientis in Australia. 

The $64,000 question that arises, is this.  Why was the actual person who uttered the allegedly defamatory opinions & beliefs on Twitter X-Spaces about Ordo Templi Orientis not sued?

Instead, the relatively innocent hosts of the show were sued for the invitee/interviewee's publicly-expressed beliefs & opinions about Ordo Templi Orientis, arising from his research and his study of the numerous prior court and tribunal cases initiated by the plaintiff. 

The answer to this question might be found in the proclivities & inconsistencies of evolved defamation law.   We'll leave speculation to academics more qualified in Australian jurisprudence than this citizen journalist.

5. Within my use of X, I follow a number of other users of X whom I have chosen to follow the social media content published by those other users. Following another user causes the X platform to populate a section of the application to show social media posts from these followed users.

6. I have also selected a few of these users to generate notification alerts for these selected users' posts on the X platform.

7. A user I had set up notification alerts is an account by the name of Cookerwatch. This user's social media feed is found at https://x.com/cookerwatch and that person uses the X username of @cookerwatch.

8. I have followed this account since early February 2023.

Presence of [NAME REDACTED] in X Space on 24 January 2024:

9. I distinctly recall reading alerts in the X application on the evening of 24 January 2024 generated from posts by user Cookerwatch. I took great interest in the post by Cookerwatch at 9.07pm, as it quoted a prior post by Cookerwatch on 16 January 2024 that featured a video of [NAME REDACTED] talking to David Oneeglio. 

This 9.07pm post also mentioned that [NAME REDACTED] was appearing live in one of the X platform's Spaces.

10. A further post by Cookerwatch at 10.27pm linked to the X Space that [NAME REDACTED] was speaking in. Spaces are live audio broadcasts hosted, and sometimes co-hosted, by X users.

11. Exhibit marked 'RWS1' is a thread of X posts, which includes Cookerwatch's posts of 24 January 2024 at 9.07pm and 10.27pm.

12. I entered this Space, via the link shared by Cookerwatch, using the anonymous listener function of X Spaces. This Space was at https://x.com/i/spaces/1vAxRvRYNZVxI

13. I saw this Space was hosted by a user named Guru. This user's social media feed is found at https://x.com/StoptheRot7 and that person uses the X username of @StoptheRot7. On reviewing activity on this account, I ascertained this X account was operated by Mr David Graham.

14. I saw this Space was co-hosted by a user named Cathryn G. This user's social media feed is found at https://x.com/CathrynAussie and that person uses the X username of @CathrynAussie. On reviewing activity on this account, I ascertained this X account was operated by Ms Cathryn Gibson.

15. I also saw that this Space's broadcast was being recorded.

16. As I had joined the conversation toward the end of this live Space broadcast, I waited for this Space to conclude before replaying this Space's audio recording.

17. While replaying this Space, I heard [NAME REDACTED] say Mr Bottrill is the leader of a paedophile cult.

18. A short time after this Space concluded, I researched tools which would allow me to download a copy of the audio.

19. I found a free Spaces audio downloading tool, called Lychee, located at https://www.lychee.so/download-space

20. I read the Lychee website and found the Lychee service converts any X Space to a downloadable MP3 audio file on request, and alerts a requester via email once the file is available for download.

21. I submitted a request via Lychee for a copy of the X Space audio.

22. I received an email from Lychee on 25 January 2024 at 12:22am that provided a link the MP3 audio of this Space. Exhibit marked 'RWS2' is a copy of that email.

23. Shortly after, I downloaded the MP3 audio file of this Space to my personal computer from the link generated by Lychee and emailed to me.

24. Similarly, I also advised Mr Bottrill that I had preserved the recording.

Presence of [NAME REDACTED] in X Space on 29 January 2024:

25. Between 25 January 2024 and 29 January 2024, researched Mr Graham and Ms Gibson by viewing their X social media posts and their profile pages.

26. I saw that Ms Gibson hosted an X Community, called Guru 'N The Aussie Crew, located at https://x.com/i/communities/1669866566903828483

27. I also saw within this X Community, and among the X posts of Mr Graham, a scheduled future Space broadcast timed on the evening of 29 January 2024. I set a reminder for this scheduled Space so I could listen live.

28. I entered this 29 January 2024 scheduled Space a few moments after this Space commenced, using the anonymous listener function of X Spaces. This Space was at https://x.com/i/spaces/1djGXNKORVexZ

29. I saw this Space was hosted by Mr Graham and co-hosted by Ms Gibson.

30. I also saw that this Space broadcast was being recorded.

31. While listening live to this Space, I heard [NAME REDACTED] say Mr Bottrill is the leader of a child abuse cult, that Mr Bottrill is a perjurer, that Mr Bottrill is a member of a satanic cult, and that Mr Bottrill's religious observance involves drinking blood and molesting children.

32. I also heard [NAME REDACTED] mention my name a number of times in this Space. Because of this, I decided I would listen to future scheduled Spaces hosted by Mr Graham.

33. After this Space concluded, I again used the Lychee Spaces audio downloading tool, and I submitted a request for a copy of the X Space audio.

34. I received an email from Lychee on 30 January 2024 at 12:30pm that provided a link the MP3 audio of this Space. Exhibit marked 'RWS3' is a copy of that email

35. Shortly after, I downloaded the MP3 audio file of this Space to my personal computer from the link generated by Lychee and emailed to me.

36. Similarly, I also advised Mr Bottrill that I had preserved the recording

Presence of [NAME REDACTED] in X Space on 3 February 2024:

37. In the days following the 29 January 2024 Space, I saw among the X posts of Mr Graham, a scheduled future Space broadcast timed on the evening of 3 February 2024. I set a reminder for this scheduled Space so I could listen live.

38. I entered this 3 February 2024 scheduled Space moments after this Space commenced, using the anonymous listener function of X Spaces. This Space was at https://x.com/i/spaces/1DXxyjZwVeZKM

39. I saw this Space was hosted by Mr Graham and co-hosted by Ms Gibson.

40. I also saw that this Space broadcast was being recorded.

41. While listening live to this Space, I heard [NAME REDACTED] say Mr Bottrill is the head of the Ordo Templi Orientis (OTO), and that the OTO is a child abuse cult with a doctrine of child abuse.

42. After this Space concluded, I again used the Lychee Spaces audio downloading tool, and I submitted a request for a copy of the X Space audio.

43. I received an email from Lychee on 4 February 2024 at 12.08am that provided a link the MP3 audio of this Space. Exhibit marked 'RWS4' is a copy of that email.

44. Shortly after, I downloaded the MP3 audio file of this Space to my personal computer from the link generated by Lychee and emailed to me.

45. Similarly, I also advised Mr Bottrill that I had preserved the recording.

Audience size of each X Space:

46. At some point in late June 2024, Mr Bottrill asked me if I could research ways to ascertain any data relating to audience size for each of the three X Spaces.

47. I reviewed X posts by Mr Graham which advertised and linked to the location of each Space. Each of these Spaces appeared to indicate a cumulative engagement count for both live and recording listeners, apparently rounded down to the nearest hundred listeners.

48. I was also able to find a website, Spaces Dashboard, which appeared to report various data points about Spaces, including the number of live listeners to a Space.

49. On 29 July 2024, I visited each X post of Mr Graham's, saving each post in a PDF file

50. I saw that the 24 January 2024 broadcast had not less than 2,100 total listeners. Exhibit marked 'RWS5' is the saved PDF showing this data.

51. I saw that the 29 January 2024 broadcast had not less than 3,300 total listeners. Exhibit marked 'RWS6' is the saved PDF showing this data.

52. I saw that the 3 February 2024 broadcast had not less than 1,900 total listeners. Exhibit marked 'RWS7' is the saved PDF showing this data.

53. On 29 July 2024, I also visited the Spaces Dashboard webpage pertaining to each Space, saving each page in a PDF file.

54. I saw that the 24 January 2024 broadcast appeared to have 1,043 live listeners. Exhibit marked 'RWS8' is the saved PDF showing this data.

55. I saw that the 29 January 2024 broadcast appeared to have 1,389 live listeners. Exhibit marked 'RWS9' is the saved PDF showing this data.
